SWEEPSTAKES PERIOD: The RYTHM Strain Giveaway (the “Sweepstakes”) starts on May 24, 2024 at 12:00 a.m. Central Time (“CT”) and ends on June 7, 2024 at 11:59 p.m. CT (“Sweepstakes Period”).

During the Sweepstakes Period, eligible entrants will be invited to post an Instagram Story, tag a friend who is twenty-one (21) years of age or older, and include the hashtag #RYTHMStrainSeriesSweepstakes, as more fully set forth below.

Entry in the Sweepstakes does not constitute entry into any other promotion, contest, or sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Green Thumb Industries (GTI), 325 W. Huron, Chicago IL 60654 (“Sponsor”), which shall be final and binding in all respects. This Sweepstakes is in no way sponsored, endorsed, or administered by Instagram. Instagram is completely released of all liability by each entrant in this Sweepstakes.

ELIGIBILITY: Sweepstakes is open to legal residents of the United States residing in CT, RI, VA, FL, NY, NJ, MA, FL, IL, NV, PA, OH, MD who are twenty-one (21) years of age or older at time of entry. Employees, officers, and directors of Sponsor, its subsidiaries, affiliates, distributors, retailers, promotion and advertising agencies, and members of their immediate families (which includes spouses and parents, children and siblings and each of their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void outside of CT, RI, VA, FL, NY, NJ, MA, FL, IL, NV, PA, OH, MD and where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.

HOW TO ENTER:

To enter the Sweepstakes, you’ll first need to become a registered user of www.Instagram.com (“Instagram”) or log-in to your Instagram account. If you do not have an account, go to www.Instagram.com to create one. Instagram accounts are free. By submitting your information and creating an Instagram account, you agree to the Instagram Terms of Use and Privacy Notice. If you do not agree to such Terms of Use and Privacy Notice, you cannot create an Instagram account, or participate in this Sweepstakes. Additionally, to enter, your account must be set to public.

During the Sweepstakes Period, to enter, you must log-in to your Instagram account, then post an Instagram Story with a picture of your Rythm Animal Face strain merchandise or packaging(“Story”); in the Story, you must tag @RYTHM_official and include the hashtag #RYTHMStrainSeriesSweepstakes to receive one (1) entry into the Sweepstakes. All Stories must be posted from a non-private social media account. As an alternative, you may enter the sweepstakes by sending a 3×5 card with the name of the sweepstakes, your name, address, email and age to Green Thumb Industries attn: Rythm Sweepstakes Entry, 325 W. Huron, Suite 700, Chicago, IL 60604

The content of your Story will not be judged and will therefore not increase or decrease your chances of winning a prize. Limit one (1) entry per person and per Instagram account. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process are void. You may only use one (1) Instagram account to enter Sweepstakes. Any entries received from any person or social media account more than the limitation stated above will be void.

REQUIREMENTS OF STORIES: Story may not contain, as determined by the Sponsor, in its sole discretion, any content that:

Is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity.
Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message.
Is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted entries.
Defames, misrepresents or contains disparaging remarks about other people or companies;
Contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others (excluding those of Sponsor), without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses.
Contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission.
Contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission.
Contains look-alikes of celebrities or other public or private figures, living or dead.
Communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
Violates any law.

Story must be response to the call-to-action message, the original work of the entrant, in compliance with Instagram’s Terms of Use available at https://help.instagram.com/581066165581870/, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the Story contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Story, any and all releases and consents necessary to permit the use and exhibition of the Story by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Story. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Story null and void. By submitting an Story, entrant warrants and represents that they and any persons appearing or who are identifiable in the Story consent to the submission and use of the Story in the Contest and to its use as otherwise set forth herein.

RANDOM DRAWINGS: One (1) potential Prize winner will be selected in a random drawing to take place at the conclusion of the Sweepstakes Period from among all eligible entries received. Odds of winning a Prize will depend upon the total number of eligible entries received during the Sweepstakes Period. Random drawing will be conducted by Sponsor, whose decisions are final and binding on all matters relating to this Sweepstakes.

WINNER NOTIFICATION: Potential winner will be notified by Sponsor via Instagram comment and/or direct message and will be required to respond to Sponsor within forty-eight (48) hours from date of initial notification. If any Prize or prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, such Prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable Prize.

PRIZE: One (1) prize (“Prize”) is available. The Prize includes:

Two (2) tickets to Lollapalooza 2024, currently scheduled to take place from August 1, 2024 through August 4, 2024 in Chicago, Illinois; and
One (1) $500 voucher intended to be used for travel and expenses to attend the Prize event.

The Approximate Retail Value of the Prize is $2,000.

All expenses not specifically provided for herein, including transportation to and from the venue, parking, concessions and merchandise (if applicable), are winner’s sole responsibility. Some restrictions may apply. Winner and their guest agree to abide by all rules, terms, conditions, restrictions and entry requirements imposed by the venue, including, but not limited to, any applicable social distancing, proof of vaccination, and masking requirements. Failing to abide by these rules, or exhibiting behavior that is deemed to be inappropriate, threatening, obnoxious, unruly, or otherwise prohibited by Sponsor or the venue shall result in possible denial of entry to the Prize-related event or ejection.

PRIZE CONDITIONS: All federal, state and local taxes and all other costs associated with Prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Winner will receive an IRS 1099 Form for the actual value of the Prize received following receipt of Prize. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. The winner may not substitute, assign or transfer Prize or redeem Prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute the Prize (or portion thereof) with one of comparable or greater value. All Prize details are at Sponsor’s sole discretion.

GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Instagram, their subsidiaries, affiliates, distributors, promotion and advertising agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any Prize; and (c) to the use of their name, voice, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor, its affiliates and agencies, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use.

LICENSE/USE OF SUBMISSIONS: By posting on Instagram as a public story, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your entry, name, comment, and biographical material including, but not limited to, all materials submitted in connection with the Sweepstakes in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries or Instagram posts or stories, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries or Instagram posts, the announcement of the Prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes including but not limited to war, strikes, health crisis, epidemic, pandemic, civil disturbances, work stoppage, and/or acts of God, which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL AVAILABLE REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the state of Illinois.

WINNER’S LIST: Winners will be announced on Sponsor’s Instagram feed @rythm_official at the conclusion of the Sweepstakes Period.
